1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the website located at mycontractingteam.com, operated by My Contracting Team, a service of National Insurance (“Company,” “we,” “us,” or “our”). These Terms apply to all visitors, licensed insurance agents, agencies, and others who access or use the Site.
By using the Site, you represent that you are at least 18 years of age, are a licensed insurance professional or are evaluating our services in a professional capacity, and have the legal authority to agree to these Terms.
These Terms incorporate our Privacy Policy by reference. Please review the Privacy Policy to understand our data practices.
2. Description of Services
My Contracting Team provides a platform through which licensed insurance agents and agencies may:
- Learn about carrier appointment and contracting services
- Initiate or complete carrier contracting applications through third-party platforms (including SureLC)
- Access information about insurance products offered by our carrier partners
- Access quoting tools, CRM resources, and lead program information
- Contact our team for support related to contracting and appointments
We are a Field Marketing Organization (FMO) and insurance brokerage. We do not underwrite insurance, set premium rates, or make coverage decisions. Those functions are the sole responsibility of the insurance carriers with whom you contract.
We reserve the right to modify, suspend, or discontinue any feature or service on the Site at any time without notice.
3. Eligibility and Agent Responsibilities
3.1 Licensing Requirements
To use our contracting services, you must hold a valid insurance producer license in each state where you intend to sell. By initiating a contracting request through our Site, you represent and warrant that:
- You hold all required state insurance licenses for the lines of business you are contracting
- Your National Producer Number (NPN) is accurate and current
- You are in good standing with all applicable state insurance departments
- You are not subject to any suspension, revocation, or other disciplinary action that would prohibit you from selling insurance
3.2 Ongoing Compliance
You are solely responsible for maintaining your insurance licenses, completing required continuing education, satisfying carrier-specific certification requirements (including AHIP for Medicare products), and complying with all applicable state and federal insurance laws and regulations.
3.3 Accurate Information
You agree to provide accurate, current, and complete information when submitting contact forms or contracting applications. Providing false or misleading information — including misrepresenting your license status or NPN — may result in immediate termination of our services to you and may be reported to applicable state insurance departments.
4. Carrier Appointments and Contracting
4.1 Role of My Contracting Team
We facilitate the contracting process between you and insurance carriers. We act as an intermediary — submitting your information to carriers and assisting with appointment paperwork — but we do not make final decisions on whether a carrier approves or denies your appointment. Carrier approval is at the sole discretion of each carrier.
4.2 No Guarantee of Appointment
Submitting a contracting request through our Site or through SureLC does not guarantee that any carrier will approve your appointment. Carriers may decline appointments based on their own underwriting criteria, production history, geographic restrictions, or other factors outside our control.
4.3 Release Policy
We maintain a written release policy governing the process by which you may transfer appointments from us to another FMO or directly to a carrier. Our current release policy is available on the Site. Nothing in these Terms prevents you from leaving My Contracting Team or transferring your carrier appointments according to the procedures described in the release policy.
4.4 Third-Party Contracting Platforms
We use SureLC and may use other third-party platforms to manage contracting workflows. By initiating a contracting request, you authorize us to share your information with these platforms as necessary to process your application. Your use of SureLC and similar platforms is also governed by their own terms of service and privacy policies.
5. Prohibited Uses
You agree not to use the Site for any of the following purposes:
- Violating any applicable federal, state, or local law or regulation
- Misrepresenting your identity, licensing status, NPN, or professional credentials
- Submitting contracting applications on behalf of another person without their express written authorization
- Transmitting unsolicited commercial email or other communications (spam)
- Uploading or transmitting viruses, malware, or any code designed to disrupt or damage the Site
- Attempting to gain unauthorized access to any portion of the Site, its servers, or connected systems
- Scraping or extracting data from the Site by automated means without our written permission
- Reproducing, distributing, or creating derivative works of any Site content without authorization
- Engaging in any conduct that could harm the reputation of My Contracting Team, National Insurance, or any carrier partner
6. Intellectual Property
6.1 Our Content
All content on the Site — including text, graphics, logos, page layouts, product descriptions, carrier information, and software — is the property of My Contracting Team, National Insurance, or their respective licensors and is protected by United States copyright, trademark, and other intellectual property laws.
You may access and use the Site for your personal, professional evaluation of our services. You may not reproduce, distribute, modify, or commercially exploit any content without our prior written consent.
6.2 Carrier Trademarks
Carrier names, logos, and product names displayed on the Site (including Aetna, Humana, UnitedHealthcare, and others) are the trademarks of their respective owners. Their display on our Site does not imply endorsement of My Contracting Team by any carrier, nor does it grant you any rights to use those marks.
6.3 Your Submissions
By submitting information through our contact form or contracting applications, you grant us a non-exclusive, royalty-free license to use that information solely to provide the services you have requested.
7. Disclaimer of Warranties
THE SITE AND ALL CONTENT, TOOLS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, My Contracting Team and National Insurance disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Site will be uninterrupted, error-free, or free of viruses or other harmful components
- Warranties regarding the accuracy, completeness, or timeliness of any content, including carrier product information or benefit descriptions
- Warranties that carrier contracting applications submitted through the Site will be approved
Insurance product information on this Site is provided for general informational purposes only. Plan details, premiums, benefits, and availability vary by carrier, plan year, and geography. Verify all product details directly with the carrier before recommending any product to a consumer.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MY CONTRACTING TEAM AND NATIONAL INSURANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES.
This includes, without limitation, damages arising from:
- Loss of income, revenue, or commissions resulting from a denied or delayed carrier appointment
- Reliance on inaccurate or outdated product information published on the Site
- Unauthorized access to or alteration of your data
- Any interruption or cessation of the Site
Our total aggregate liability to you for any claim arising from your use of the Site shall not exceed $100 USD.
9. Indemnification
You agree to defend, indemnify, and hold harmless My Contracting Team, National Insurance, and their respective officers, directors, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Site or our services
- Your violation of these Terms
- Your violation of any applicable law or regulation, including insurance licensing laws
- Any misrepresentation you make in connection with a contracting application
- Any claim by a third party arising from your conduct as an insurance producer
10. Third-Party Links and Services
The Site contains links to third-party websites including carrier websites, SureLC, NIPR, and other industry resources. These links are provided for your convenience. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party site. We encourage you to review those policies before providing any personal information.
11. Termination
We reserve the right to terminate or suspend your access to the Site and our services at any time, with or without cause and with or without notice, including if we believe you have violated these Terms, provided false information, or engaged in conduct harmful to us, our carriers, or other agents.
Upon termination, your right to use the Site ceases immediately. Carrier appointments already in place are governed by the terms of your individual carrier agreements and our release policy. Sections 6, 7, 8, 9, and 12 survive termination.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
12.2 Dispute Resolution
Any dispute arising from or relating to these Terms shall first be submitted to good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Texas.
12.3 Class Action Waiver
YOU AND MY CONTRACTING TEAM EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY.
12.4 Exceptions
Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute.
13. Changes to These Terms
We may update these Terms at any time. When we make material changes, we will update the Effective Date at the top of this page and post a notice on our homepage. Your continued use of the Site after the effective date of any update constitutes your acceptance of the revised Terms.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any written contracting or appointment agreements you enter into with us separately, constitute the entire agreement between you and My Contracting Team regarding your use of the Site.
14.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
14.3 Waiver
Our failure to enforce any provision of these Terms on any occasion does not constitute a waiver of our right to enforce that provision in the future.
14.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
14.5 Force Majeure
We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, government actions, internet outages, or carrier system failures.
